Terms of Service

These Terms of Service ("Terms") govern your access to and use of FourMind AI (the "Service"), operated by Pixel Fox Games Inc ("FourMind", "we", "us", or "our"), a company located at 640 S W Temple St, Salt Lake City, UT 84101. By creating an account or using the Service, you agree to be bound by these Terms.

1. License to use the Service

Subject to these Terms, Pixel Fox Games Inc grants you a limited, non-exclusive, non-transferable license to access and use the Service for your own personal or internal business use. Except where applicable law expressly allows, you may not sell, copy, modify, interfere with, reverse engineer, exploit, or otherwise misuse the Service.

2. The Service

FourMind AI provides access to conversational AI agents ("Agents") that are built on top of third-party AI models. We do not train or operate the underlying models ourselves, and their outputs are generated automatically and may be inaccurate, incomplete, or inappropriate for your use case.

3. Eligibility and accounts

  • You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You must provide accurate information when registering and keep it up to date.

4. Credits and payments

  • Access to the Agents is metered using "credits." New accounts receive a limited number of welcome credits.
  • Additional credits may be purchased through the Pricing page. Payments are processed by a third-party payment processor; available payment methods (such as card, Apple Pay, Google Pay, or Cash App Pay) depend on your device, region, and browser.
  • Credits are consumed when you send a message to an Agent, regardless of whether you are satisfied with the response, except where the Service fails to return any response due to a technical error, in which case credits are not charged.
  • Credits have no cash value, are non-transferable, and (unless required by law) are non-refundable once used. See our Refund Policy for details on refund eligibility for unused purchases.

5. Acceptable use

You agree not to use the Service to:

  • Generate or distribute unlawful, defamatory, hateful, or sexually exploitative content, or content involving minors.
  • Generate political propaganda intended to manipulate public opinion at scale, disinformation presented as fact, or content inciting violence or hatred based on political affiliation.
  • Attempt to circumvent credit metering, rate limits, or security controls.
  • Reverse engineer, scrape, or resell access to the Service without our written permission.
  • Use the Service to develop a competing product using our systems or outputs at scale.
  • Use bots, scripts, or unauthorized automation tools to interact with the Service.
  • Attempt to manipulate payments or credits, or interfere with the Service's infrastructure, other users, or normal operation.

6. AI-generated content disclaimer

Responses from the Agents are generated by automated, third-party AI models and do not reflect the views of Pixel Fox Games Inc. You should independently verify any factual, medical, legal, or financial information before relying on it. We are not liable for decisions made based on Agent output.

7. Intellectual property

The FourMind AI name, logo, and website design are owned by Pixel Fox Games Inc. Subject to these Terms, you may use output you generate for personal or commercial purposes, but you are responsible for ensuring your use complies with applicable law and any third-party rights.

8. Service availability and changes

We may add, modify, suspend, or discontinue any feature of the Service at any time, with or without notice. The Service depends in part on third-party AI model providers, our payment processor, and hosting infrastructure, and their availability, performance, or policies may affect the Service. We are not liable for interruptions caused by factors outside our reasonable control.

9. OFAC sanctions and geographic restrictions

We strictly comply with all trade sanctions, export control laws, and regulatory requirements enforced by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), as well as other applicable international and U.S. federal and state trade restriction laws. We do not offer, sell, ship, deliver, or facilitate any transactions for products and services to individuals, entities, jurisdictions, or regions subject to comprehensive or targeted U.S. sanctions, including without limitation Cuba, Iran, North Korea, Sudan, Syria, and restricted regions of Ukraine (Crimea, Donetsk, Luhansk), as well as any parties listed on OFAC's Specially Designated Nationals (SDN) List, Blocked Persons List, and other applicable sanctions lists.

You warrant and represent that you are not located in, organized under the laws of, or a resident of any sanctioned jurisdiction, nor are you listed on any U.S. or international government sanctions, watchlist, or restricted party roster.

We reserve the absolute right to cancel, suspend, reject, or terminate any order, transaction, user account, or service access at any time, without prior notice or refund eligibility, if we reasonably determine the transaction or user involves sanctioned territories, restricted parties, or violates any OFAC trade control regulations. We bear no liability for any rejected or terminated transactions arising from sanctions compliance obligations.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may stop using the Service at any time. Unused credits are handled according to our Refund Policy upon account termination.

11. Disclaimers and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, Pixel Fox Games Inc will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, and our total liability will not exceed the amount you paid us in the 12 months preceding the claim.

12. Governing law and dispute resolution

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law principles. If a dispute arises, please contact us first so we can try to resolve it informally. Any controversy or claim that cannot be resolved informally shall be settled by binding arbitration administered under the rules of a recognized arbitration association, seated in Utah unless otherwise mutually agreed, and judgment on the award may be entered in any court having jurisdiction. You and Pixel Fox Games Inc each waive any right to bring a claim as a plaintiff or class member in any purported class, collective, or representative proceeding.

13. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
